Special Counsel Jack Smith plans to resign before the new president takes office in the White House. His aim is to complete his work and prevent Trump's incoming promise to fire him immediately after taking the oath. The timeline for the completion of his work is still unknown.
The special counsel's report will be sent to the U.S. Attorney General and may be made public with some redactions. Justice Department rules require the prosecutor to explain the reasons for bringing charges or not bringing charges.
It is unclear whether the Attorney General will release the report before leaving or if that decision will be left to his successor.
